Holding
The application for regular bail is dismissed.
Summary
Baldev Singh Bhokata was charged under Section 396 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act in connection with a case registered in 2019. He filed a third application for regular bail, arguing that he should be released pending trial. The State opposed, indicating that witness examination was ongoing and further witnesses were scheduled for future dates. The court examined the gravity of the offences and noted that the trial was actively progressing. Considering these factors, the court found no justification to revisit its earlier bail order. Consequently, the application for regular bail was dismissed.
Issues considered
- Whether regular bail should be granted to the petitioner given the seriousness of the offences under IPC 396 and the Arms Act
