Holding

The court granted regular bail to the petitioner, directing his release upon furnishing the prescribed bail bond and sureties.

Summary

The petitioner, Rajeshwar Ram, father‑in‑law of the deceased Kajal Kumari, sought regular bail in a case registered under multiple sections of the Bihar Penal Code and the Dowry Prohibition Act. The prosecution alleged that the deceased was subjected to dowry‑related cruelty and was killed by her in‑laws shortly after her marriage to Sunny Kumar. The petitioner contended that he was innocent, that the allegations primarily targeted the husband, and that he had been in judicial custody since 10‑02‑2026. The State opposed the bail application. After hearing both sides, the court found no compelling reason to deny bail and ordered the petitioner’s release on a bail bond of Rs.10,000 with two sureties, subject to the satisfaction of the Chief Judicial Magistrate, Jehanabad.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious nature of the offences alleged under the Bihar Penal Code and the Dowry Prohibition Act.
