Anticipatory bail was denied.
Summary
Kranti Kumar, a manager-cum-godown in‑charge of Sarika Indian Gramin Distributer, was implicated in an FIR alleging misappropriation of LPG cylinders, cash of Rs. 7 lakh and official documents. He filed a petition for anticipatory bail under Section 306 of the B.N.S., claiming innocence and that the case was based merely on suspicion. The State opposed the bail, highlighting the specific accusations and the petitioner’s prior similar criminal antecedent. The court examined the seriousness of the allegations, the direct nature of the charge and the petitioner’s past record. Concluding that the circumstances warranted denial of bail, the court rejected the anticipatory bail application.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 306 of the B.N.S. in view of the specific allegations of misappropriation.
- Whether the petitioner’s prior criminal antecedent justifies denial of anticipatory bail.
