Holding
The court granted regular bail to the petitioner.
Summary
The petitioner, Ranjeet Yadav, was charged under sections 190, 103(1) and 81(2) of the B.N.S. for allegedly assaulting the brother of an informant with a sharp weapon, leading to the victim's death. He applied for regular bail, claiming innocence, lack of specific allegations against him, and no prior criminal record, while noting that a co‑accused had been granted anticipatory bail in a similar case. The State opposed the bail, arguing the seriousness of the offences. After hearing both sides, the court found the petitioner's circumstances—such as the general nature of the allegations and his prolonged pre‑trial detention—sufficient to merit bail. Consequently, the court ordered his release on a bail bond of Rs 10,000 with two sureties, directing compliance with the J.M. 1st Class Court in Gopalganj.
Issues considered
- Whether the petitioner is entitled to regular bail despite charges of assault leading to death under sections 190, 103(1) and 81(2) of the B.N.S.
- Whether the general nature of the FIR allegations and the grant of anticipatory bail to a co‑accused justify regular bail for the petitioner
- Whether the petitioner’s lack of criminal antecedents and prolonged pre‑trial custody warrant bail
