Decided

DISMISSED

Holding

The bail application was dismissed, and the petitioner was not granted bail.

Summary

Vinod Singh was charged under several sections of the Bharatiya Nyaya Sanhita, 2023, for an alleged assault resulting in death. He applied for bail for the second time after an earlier bail denial in August 2025. The trial has progressed with most witnesses examined, and the prosecution maintains that Singh was one of the assailants. The High Court, noting the seriousness of the offences and the stage of the trial, refused to overturn its earlier order and dismissed the bail application. The court also directed the trial court to expedite the remaining proceedings and instructed the Superintendent of Police to ensure witness attendance.

Issues considered

  • Whether the petitioner is entitled to bail at this stage of the trial despite being alleged as an assailant in a serious offence.
