Bail was granted to the petitioner subject to a Rs.10,000 bond, two sureties and specific conditions.
Summary
Ashok Kumar Choudhary was arrested on 18 February 2026 in connection with a vigilance case alleging that he demanded a Rs.10,000 bribe from an informant for the release of the informant's vehicle, offences under Sections 7(a), 7(c) and 12 of the Prevention of Corruption Act, 1988 and Section 61(2) of the BNS, 2023. The prosecution presented a charge sheet and claimed the petitioner was caught with Rs.8,000 recovered from the informant. The petitioner’s counsel argued that he has a clean antecedent, the allegations are fabricated, and he is not in a position to release the vehicle. The court examined the material and, considering the circumstances, ordered the petitioner’s release on bail upon furnishing a bond of Rs.10,000 with two sureties and several conditions regarding cooperation, non‑tampering with evidence, and verification of antecedents. The bail order was conditioned on compliance with the stipulated terms.
Issues considered
- Whether bail should be granted to the petitioner in a case involving alleged offences under the Prevention of Corruption Act, 1988 and the BNS, 2023
- Whether the petitioner poses a risk of fleeing, tampering with evidence or influencing witnesses
- Whether the bond and surety conditions are sufficient to secure the petitioner’s appearance
