BAIL GRANTED

Holding

The Court granted regular bail to the petitioner.

Summary

The petitioner, Vikram Das, was arrested in connection with the recovery of 1,455.48 liters of illicit liquor seized from a pickup van at a poultry farm. The prosecution alleged his involvement under Section 30(a) of the Bihar Prohibition and Excise Amendment Act. The petitioner contended that he was innocent, that his name appeared only in the confessional statements of co-accused, and that no incriminating material was found in his possession. The State opposed the bail, arguing the seriousness of the offence. The Court, after considering the lack of direct evidence against the petitioner and the period of custody, allowed the regular bail on a bond of Rs. 10,000 with two sureties, directing compliance with the Excise Court.

Issues considered

  • Whether regular bail can be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise Amendment Act in the absence of direct incriminating evidence.
