Patna High Court

Azad Khan @ Ahad KhanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a cash bond, sureties, and specific conditions.

Summary

Azad Khan was arrested on 23 March 2026 in connection with a 2024 FIR alleging offences under several sections of the Bihar Narcotic Substances Act, 2023 and Section 27 of the Arms Act. An earlier anticipatory bail order dated 8 January 2025 could not be acted upon because the court found a criminal antecedent, and a request to modify that order was dismissed on 23 September 2025. The petitioner argued that he was falsely implicated, that the assault allegation pertained to a co‑accused, and that other co‑accused had already been granted bail. The prosecution opposed bail, citing five prior criminal cases against the petitioner, though noting he was on bail in another pending matter. The court, after considering the circumstances, granted bail on a bond of Rs 10,000 with two sureties, subject to conditions of cooperation, presence in court, non‑tampering with evidence, and verification of criminal antecedents.

Issues considered

  • Whether bail should be granted to a petitioner charged with multiple serious offences despite having prior criminal antecedents.
  • Whether the earlier anticipatory bail order can be modified or superseded after its dismissal.

                               2. Petitioner seeks bail who is in custody since

23.03.2026 in connection with Sugauli P.S. Case No. 321 of

2024, F.I.R. dated 19.07.2024 for the offences punishable under

Cr. Misc. No. 89048 of 2024 by this Court but the bail bond of

the petitioner could not be furnished due to criminal antecedent

of the petitioner. Thereafter, the petitioner has moved before this

          dismissed vide order dated 23.09.2025.

                      4. Learned counsel for the petitioner submits that

petitioner is innocent and he has falsely been implicated in the

present case. He further submits that there is case and counter

case between the parties and the specific allegation of assault is

against the co-accused, namely, Mintu Khan who has assaulted

to the victim due to which he received injury but his injury

report suggest that the injury is simple in nature. As per the

allegation, there is no specific allegation of assault against this

petitioner and number of co-accused persons have been granted

bail by this Court and by Co-ordinate Bench of this Court. The

petitioner is in custody since 23.03.2026.

                      5. The learned Additional Public Prosecutor has

vehemently opposed the prayer for bail of the petitioner on the

ground that petitioner carries five criminal antecedents other

than the present one but fairly submits that he is on bail in the

          pending matter.

                       6. Considering the aforesaid facts and circumstances,

let the petitioner, above named, be released on bail on furnishing

bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of

the like amount each to the satisfaction of the learned J.M. 1st
