Decided

BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioners subject to bond and surety conditions.

Summary

Petitioners Prabhu Prasad and Fulmati Devi sought anticipatory bail fearing arrest in a case involving alleged assault under several sections of the BNS. They contended that the incident arose from a construction‑related altercation, that petitioner 1 was himself injured and that the alleged injuries to the informant were caused by a blunt object, not a sharp weapon as claimed by the prosecution. The State argued that petitioner 1 used a sharp weapon to inflict serious injury. The court noted the lack of corroborative medical evidence of a severe head injury, the presence of a counter‑case, and the fact that a co‑accused had already been granted anticipatory bail. Accordingly, the court granted anticipatory bail to both petitioners subject to a bond of Rs 20,000 and two sureties, under Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners given the nature of the alleged offences and the evidence of injuries.
