Decided
Disposal
BAIL REJECTED

Holding

The petition for pre‑arrest bail was denied.

Summary

The petitioner, Prabhunath Singh, applied for pre‑arrest bail after being named in an FIR alleging that he and others, armed with rifles, demanded ransom and fired indiscriminately, injuring Manoj Kumar. The FIR charges him under sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 109, 308(3) and 351 of the Bihar Penal Code and section 27 of the Arms Act. The petitioner feared arrest and sought bail, arguing that the allegations were not yet proved. The Court examined the seriousness of the offences, the presence of firearms, and the injury caused to a victim. Considering the gravity of the accusations and the risk to public order, the Court rejected the petition for pre‑arrest bail. The order was pronounced by Justice Prabhat Kumar Singh.

Issues considered
