Decided

BAIL GRANTED

Holding

The court granted regular bail to the petitioner subject to a bail bond and a condition to deposit Rs. 25,000 with a charitable organization.

Summary

Petitioner Pankaj Sahni was arrested on 13 March 2026 in connection with the recovery of 103 litres of illicit liquor, alleged to be an offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2022. He claimed innocence, clean antecedents, and offered to donate Rs. 25,000 to a charitable organization as part of his bail undertaking. The State opposed the bail, but the court, after considering the custody period and submissions, granted regular bail. The court ordered the petitioner to furnish a bail bond of Rs. 10,000 with two sureties of the same amount and to deposit the Rs. 25,000 donation with the Ramakrishna Mission Ashrama, producing a receipt. The order was made on a prima facie basis, without prejudice to the merits of the trial.

Issues considered

  • Whether regular bail should be granted to the accused in an offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2022.
  • Whether the petitioner poses a risk of fleeing, tampering with evidence, or influencing witnesses.
