Patna High Court

PukhrajversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to specified conditions.

Summary

Pukhraj, a resident of Rajasthan, was arrested on 15 January 2026 in connection with a case involving the seizure of 2,800.44 litres of foreign liquor from a truck, alleged under Section 30(a) of the Bihar Prohibition and Excise Act, 2022. The petitioner contended that he had no ownership interest in the truck, possessed a clean criminal record, and that the police investigation violated Sections 103 and 105 of the Bihar Narcotic Substances (Suppression) Act, 2023. The State opposed bail. The High Court, noting the petitioner’s clean antecedent, the non‑ownership of the seized vehicle, and the alleged procedural lapses, ordered that bail be granted on a bond of Rs.10,000 with two sureties, subject to several conditions regarding court attendance, non‑tampering with evidence, and verification of antecedents. The bail order was directed to be implemented by the Special Judge (Excise) in Samastipur.

Issues considered

  • Whether bail should be granted to the accused despite the alleged non‑compliance of Sections 103 and 105 of the BNSS, 2023.
  • Whether the petitioner’s lack of ownership of the seized truck and clean antecedent justify bail.
