Bail was granted to the petitioner subject to a bond of Rs. 10,000 and specified conditions.
Summary
Badahru Ram was arrested on 30 March 2026 in connection with the seizure of 105 litres of country-made liquor, alleged to be an offence under Section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2022. The petitioner claimed he had no prior criminal record and that the liquor was not found in his conscious possession, the accusation being based solely on a local watchman's statement. The State opposed bail, but the court noted the lack of material evidence linking the petitioner directly to the contraband and his clean antecedents. Consequently, the court granted bail on a bond of Rs. 10,000 with two sureties, imposing conditions of cooperation, appearance, and non‑tampering with evidence. The bail order was made subject to verification of the petitioner’s criminal antecedents, with provisions for cancellation if conditions are breached.
Issues considered
- Whether bail should be granted to the accused in a case under Section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2022 when no contraband was recovered from his conscious possession.
- Whether the petitioner’s clean antecedent and the nature of the evidence (reliance on a watchman's disclosure) justify bail.
