Patna High Court

Sanjeev Kumar @ Sanjiv KumarversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The bail application was dismissed.

Summary

The petitioner, Sanjeev Kumar, was arrested in connection with a case registered under the Gaya Rail Police Station for alleged offences under Sections 8, 18(c) and 20(b) of the Narcotic Drugs and Psychotropic Substances (NDPS) Act, with 32 kg of doda seized. He applied for regular bail, claiming he was falsely implicated, has no prior criminal record, and has been in custody since 31 July 2025, undertaking to cooperate with the trial. The State, represented by an Additional Public Prosecutor, opposed the bail on the ground of the seriousness of the offence and the large quantity of narcotics involved. The Court, noting the huge recovery, was not inclined to grant bail and dismissed the application, directing the lower court to expedite the trial and allowing the petitioner to re‑apply for bail if necessary. The order reflects the Court’s cautious approach in NDPS cases involving large drug seizures.

Issues considered

  • Whether bail should be granted to an accused in an NDPS case involving a large quantity of narcotics.
  • Whether the petitioner’s claim of false implication and lack of antecedents outweighs the seriousness of the offence.

Legislation cited

Subjects

  • bail
  • NDPS Act
  • drug trafficking
  • large quantity seizure
  • pre‑trial detention
