BAIL GRANTED

Holding

The court granted bail to the petitioner subject to bond and conditions.

Summary

The petitioner, Ravi Pandit, sought bail in a complaint case filed by his wife alleging dowry harassment and assault under IPC sections 498A, 323, 341/342. The prosecution alleged that the petitioner threw the complainant out of the matrimonial home to demand dowry, while the petitioner claimed the allegations were false and that he had no criminal antecedent. The petitioner had been in custody since June 2, 2025. The court considered the nature of the allegations, the petitioner’s clean record, and the length of custody, and decided to grant bail. Bail was ordered on a bond of Rs.10,000 with two sureties and subject to conditions under Section 480(3) of the Bihar Negotiable Instruments Act and additional personal conditions. The order was pronounced by Justice Arun Kumar Jha.

Issues considered

  • Whether bail should be granted to the accused under sections 498A, 323, 341/342 of the IPC.
  • Whether the allegations constitute a false case affecting the grant of bail.
  • Whether the petitioner’s clean antecedent and period of custody justify bail.

                   APP for the State.

                                 02. In the present case, the petitioner seeks bail in

connection with Complaint Case No. 1123 of 2019 wherein

processes were directed to be issued after cognizance being

taken for the offences under Sections 498A, 323, 341/34 of the

                   Indian Penal Code.

                                 03. As per prosecution case, the petitioner is the

husband of the complainant and allegations are throwing out the

complainant from her matrimonial home on account of non-

          fulfillment of demand of dowry.

                       04. Learned counsel for the petitioner submits that the

petitioner is innocent and has been falsely implicated in this

case. The petitioner and the complainant have a child aged about

three years and the petitioner wants to keep the complainant

with honour and dignity but she is not ready for that and she

refused to live with the petitioner. The complainant has been

insisting that the petitioner should live separate from his aged

parents and for this reason, she has filed this false case. The

allegation of demand of dowry is completely false and no

cognizance has been taken under any provision of the Dowry

Prohibition Act and the cognizance has been taken under

Sections 498A, 323, 341/34 of the Indian Penal Code. The

petitioner has got no criminal antecedent and he is in custody

          since 02.06.2025.

                       05. Learned APP opposes the submission made on

          behalf of the petitioner.

                       06. Having regard to the facts and circumstances and

submissions made on behalf of the parties and considering the

nature of allegation against the petitioner and also considering

the period of custody of the petitioner and his clean antecedent,

the petitioner above named is directed to be released on bail on
