Patna High Court

Vijay KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail should be granted to the petitioner subject to strict conditions.

Summary

Vijay Kumar was arrested on 16‑04‑2025 in connection with a kidnapping case (FIR dated 13‑04‑2025) and charged under several sections of the Indian Penal Code, the Bihar Narcotic Substances Act and the Information Technology Act. The petitioner contended that he was falsely implicated, noting that other co‑accused had already been granted bail and that a co‑accused had confessed to the crime. The State opposed bail, arguing that the petitioner participated in the offence and had another pending case. The Court considered the length of custody, the nature of the charges and the petitioner’s claim of false implication. It ordered that the petitioner be released on bail upon furnishing a bond of Rs 10,000 with two sureties, subject to conditions of cooperation, non‑tampering with evidence or witnesses, and verification of his criminal antecedent. The bail order was pronounced with the stipulation that violation of any condition could lead to cancellation.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious nature of the offences and the period of custody
  • Whether the petitioner’s claim of false implication and the bail of co‑accused affect the bail decision
  • Whether the court may impose conditions such as verification of criminal antecedent and non‑tampering with evidence
