Ravi YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a bond of Rs 10,000 and two sureties, with specified conditions.

Summary

Ravi Yadav was arrested on 9 April 2026 in connection with a case involving the alleged illegal manufacture and possession of 330 litres of country‑made liquor, alleged under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018. The petitioner claimed he was falsely implicated, arguing that the seized liquor was recovered from the place of occurrence and not from his personal possession, and that the seizure list violated Sections 103 and 105 of the Bihar Narcotic Substances Act, 2023. The prosecution opposed bail, citing two prior criminal antecedents, though the petitioner was already out on bail in those matters. The court examined the facts, the nature of the offence and the procedural issues, and decided that bail could be granted. Accordingly, the petitioner was released on a bail bond of Rs 10,000 with two sureties, subject to conditions of cooperation, appearance, non‑tampering with evidence, and verification of his criminal antecedents.

Issues considered

  • Whether bail should be granted for an offence punishable under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.
  • Whether alleged non‑compliance with Sections 103/105 of the Bihar Narcotic Substances Act, 2023 impacts the bail application.
  • Whether the petitioner’s prior criminal antecedents justify denial of bail.

total 330 liters of country made liquor has been recovered from

5 The learned Additional Public Prosecutor has

than the present one but fairly submits that he is on bail in both

          the pending matters.
