The court granted bail to the petitioners subject to the conditions imposed under Section 480(3) of the BNSS.
Summary
The petitioners, Ankush Kumar and Ravi Kumar, were arrested in connection with PS case No. 852 of 2025, alleged to have participated in a firing incident and charged under several IPC sections and Section 27 of the Arms Act. The prosecution’s case was based on police information and recovered cartridges, but no eyewitness, identification parade, or material directly linking the petitioners to the offence was presented. The petitioners contended they were falsely implicated and highlighted the lack of specific allegations and evidence against them. The State opposed bail, citing the seriousness of the charges. Considering the vague allegations, absence of incriminating material, and the length of custody, the court ordered bail for each petitioner on a bond of Rs.10,000 with two sureties, subject to conditions under Section 480(3) of the BNSS and other stipulated terms. The bail order was made to ensure the petitioners’ presence in court and to prevent misuse of the judicial process.
Issues considered
- Whether bail should be granted to the accused given the vague nature of the allegations and lack of material evidence
- Whether the conditions prescribed under Section 480(3) of the BNSS are applicable to the bail order
