The court granted anticipatory bail to the petitioner, subject to conditions, finding that the statutory bar does not preclude bail in the circumstances.
Summary
Petitioner Priya Kumari sought anticipatory bail after being implicated in a case (No.227/2021) under Section 30(a) of the Bihar Prohibition and Excise Act for alleged possession of 120 litres of country‑made liquor seized from two motorcycles. She argued that the liquor was not recovered from her conscious possession, she has a clean antecedent, and the FIR is fabricated. The State opposed bail, invoking Section 76(2) of the same Act, which bars pre‑arrest bail. The High Court, relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar (2019) and considering the facts, granted anticipatory bail subject to conditions under Section 438(2) of the CrPC, including a bail bond, sureties, and compliance with further directives.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under Section 438 of the CrPC despite the bar in Section 76(2) of the Bihar Prohibition and Excise Act.
- Whether the absence of liquor in the petitioner’s conscious possession and her clean antecedent justify granting anticipatory bail.
- Whether the precedent set in Ram Vinay Yadav v. State of Bihar is applicable to the present facts.
