Patna High Court

Durgesh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner, subject to a bond and conditions, as the circumstances did not warrant continued detention.

Summary

Durgesh Kumar, the owner of a Toyota Etios, was implicated in a case where police seized 175.5 litres of foreign liquor from the vehicle under Section 30(a) of the Bihar Prohibition & Excise Act. The petitioner argued that he was not present at the spot, had no knowledge of the liquor, and possessed a clean antecedent, and therefore sought bail. The State opposed the bail application. The court noted that the petitioner was not apprehended at the time of seizure and no incriminating article was recovered from his possession. Applying Section 482(2) of the B.N.S.S., the court ordered his release on bail upon furnishing a bond of Rs 10,000 with two sureties, subject to verification of his criminal antecedent. The order further directed that bail not be delayed for the purpose of verification.

Issues considered

  • Whether bail can be granted to the petitioner under Section 482(2) of the B.N.S.S. in view of the alleged offence under Section 30(a) of the Bihar Prohibition & Excise Act.
  • Whether the petitioner’s non‑apprehension at the spot and lack of possession of the liquor justify the grant of bail.
