The court allowed the petition for anticipatory bail, subject to conditions under Section 482(2) of the B.N.S.S.
Summary
The petitioner, Santosh Mahto, sought anticipatory bail fearing arrest in a criminal case (Katihar Town P.S. Case No. 159 of 2026) alleging offences under several sections of the Bharitya Nagrik Suraksha Sanhita (B.N.S.S.). The prosecution alleged that Rs. 6,10,000 was taken from the petitioner’s husband for a sale deed that was never executed, and that the petitioner and associates verbally abused and physically pushed the informant. The petitioner contended that he was falsely implicated, that the matter was essentially a civil dispute over a contract, had issued legal notices, filed a suit for specific performance, and possessed no criminal antecedent. The State opposed the bail, asserting that the petitioner intended to defraud the informant. The court, after considering the facts, granted anticipatory bail on the condition of a bail bond and sureties, subject to Section 482(2) of the B.N.S.S.
Issues considered
- Whether anticipatory bail should be granted to the petitioner despite the serious allegations.
- Whether the matter constitutes a civil dispute rather than a criminal offence.
- Whether there is a prima facie case of fraud warranting denial of bail.
