Patna High Court

Kishundeo MukhiyaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court allowed anticipatory bail for petitioners Nos.1,2,3 and 5, subject to bail‑bond and conditions under Section 482(2) of the B.N.S.S.

Summary

The petitioners, five brothers named Mukhiya, filed an anticipatory bail application fearing arrest in PS Adapur case No. 333 of 2025, which involved offences under multiple sections of the B.N.S. The fourth petitioner, Kishori Mukhiya, was already arrested, and his bail application was withdrawn. The remaining petitioners argued that only the fourth petitioner faced assault allegations and that the case stemmed from a private dispute without premeditation. The State opposed the anticipatory bail. After hearing both sides, the court granted anticipatory bail to petitioners 1, 2, 3 and 5, subject to a bail bond of Rs.10,000 with two sureties each and conditions under Section 482(2) of the B.N.S.S.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under the applicable provisions.
  • Whether the allegations against the petitioners justify denial of anticipatory bail.
