Patna High Court

Vivek KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that anticipatory bail could be granted as the FIR did not establish a prima facie case under the Act and the petitioner had no possession of the contraband.

Summary

Vivek Kumar applied for anticipatory bail after being implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act for allegedly transporting 82 litres of Nepali Saufi wine. The prosecution alleged that the vehicle was intercepted during a police raid, but the petitioner claimed ownership of the vehicle and no criminal antecedent. Relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar, which allowed anticipatory bail despite the bar under Section 76(2) when the FIR does not establish an offence, the court examined the merits. The court found no material recovered from the petitioner’s possession and was persuaded by the arguments. Consequently, the court granted anticipatory bail subject to a Rs.10,000 bond, two sureties, and several conditions under Section 438(2) of the Cr.P.C. The order directs the petitioner to cooperate with investigations and comply with attendance requirements.

Issues considered

  • Whether anticipatory bail can be granted in a case under the Bihar Prohibition and Excise Act despite the bar under Section 76(2) of the Act.
  • Whether the facts alleged in the FIR constitute an offence under Section 30(a) of the Bihar Prohibition and Excise Act sufficient to deny anticipatory bail.

                                       ORAL ORDER

2 19-05-2026 1. Heard the parties through virtual mode.

                                 2. The petitioner is apprehending arrest in connection

with Riga P.S. Case No. 422 of 2025 instituted under Sections

30(a) of the Bihar Prohibition and Excise Act.

                                3. As per the prosecution story, on 01.11.2025, during

patrolling duty, the police party, acting on secret information,

reached Bhavdepur Darbar orchard and intercepted a Toto

vehicle bearing registration no. BR-30ER-4611, from which 82

liters of Nepali Saufi wine was allegedly recovered. It is further

alleged that one accused person was apprehended at the spot

whereas another succeeded in fleeing away. This led to the FIR.

                                4. Learned counsel for the petitioner submits that he

has no criminal antecedent and that the petitioner is the owner

                   of the vehicle.

                       5. Further, learned counsel for the petitioner relied on

the judgment of the Full Bench of Hon’ble Patna High Court in

the case of Ram Vinay Yadav vs. State of Bihar reported in

2019(2) PLJR 1089 wherein it has been held that an application

for anticipatory bail in a case arising out of Bihar Excise and

Prohibition Act can be maintained, despite the bar under Section

76(2) of the Act, if on the basis of allegation made in the FIR,

no offence under the said provision is made out.

                       6. Learned APP, Mr. Choubey Jawahar opposes the

          prayer for anticipatory bail.

                       7. Taking into account the submissions of the parties

and the judgment in the case of Ram Vinay Yadav (supra), as

also that nothing has been recovered from his conscious

possession of the petitioner, in that background this Court is

inclined to extend him the privilege of anticipatory bail.

                       8. Let the petitioner be released on bail, in the event

of his arrest or surrender before the concerned court within a

period of four weeks from the receipt of this order, on furnishing

bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of
