The court granted anticipatory bail to the petitioner, subject to stringent conditions, despite the restriction under Section 76(2) of the Bihar Prohibition and Excise Act.
Summary
Mahesh Kumar Mahto applied for anticipatory bail after being implicated in a case alleging recovery of 108 litres of Nepali liquor from his vehicle under Sections 30(a), 32(1) and 32(3) of the Bihar Prohibition and Excise Act. The prosecution opposed bail, invoking Section 76(2) of the same Act which restricts pre‑arrest bail in excise matters. The petitioner argued that no liquor was found in his conscious possession, he has a clean antecedent, and his ownership of the vehicle alone should not make him an accused. Relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar, the court held that anticipatory bail could be granted despite the statutory restriction, provided strict conditions are imposed. Accordingly, the court ordered anticipatory bail on a Rs 10,000 bond with two sureties and imposed conditions under Section 438(2) of the CrPC, including cooperation with the trial and non‑tampering with evidence.
Issues considered
- What is the applicability of Section 76(2) of the Bihar Prohibition and Excise Act to pre‑arrest (anticipatory) bail?
- Whether ownership of a vehicle from which liquor is recovered suffices to make the owner an accused for bail purposes?
- Whether anticipatory bail can be granted under Section 438 CrPC in excise cases where no conscious possession is established.
