Decided

DISMISSED

Holding

Anticipatory bail was denied to the petitioner.

Summary

The petitioner, Sanoj Ram, sought anticipatory bail fearing arrest in a theft case involving a motorcycle, alleged under Section 303(2) of the B.N.S. The prosecution presented CCTV footage showing the petitioner’s face and recovered the stolen motorcycle from his premises. The petitioner claimed innocence, noting he was not named in the FIR and has only one prior criminal antecedent. The State opposed the bail, emphasizing the evidentiary material linking the petitioner to the crime. The Court, considering the recovered vehicle and CCTV evidence, declined to grant anticipatory bail and ordered the petitioner to surrender within four weeks and apply for regular bail.
