Decided

BAIL GRANTED

Holding

The court held that anticipatory bail could be granted to the petitioner subject to conditions under Section 482(2) of the Bharitya Nagrik Suraksha Sanhita.

Summary

The petitioner, Kanhaiya Kumar, sought anticipatory bail after being implicated in a case alleging that he and several co‑accused fired indiscriminately at an informant’s house, causing injuries, and were charged under multiple sections of the Bharitya Nagrik Suraksha Sanhita (B.N.S.S.) and Section 27 of the Arms Act. The petitioner claimed innocence, alleging that the informant was involved in illegal liquor trade and that the accusations were a false implication, and highlighted his clean criminal record. The State opposed the bail, arguing the seriousness of the offences. After hearing both sides, the court considered the facts, the nature of the allegations, and the provisions of Section 482(2) of the B.N.S.S. The court ordered that the petitioner be granted anticipatory bail, subject to a bail bond of Rs 10,000 with two sureties and conditions prescribed under the statute. The application for anticipatory bail was allowed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite the serious charges under the B.N.S.S. and the Arms Act
  • Whether the allegations against the petitioner constitute sufficient ground to deny bail
