The Court granted anticipatory bail to the petitioners, subject to surrender, bail bond and surety conditions under Section 482(2) of the BNSS.
Summary
The petitioners Raju Yadav, Ayush Gupta and Sudhir Sahni applied for anticipatory bail fearing arrest in connection with Tajpur Police Station Case No. 64 of 2026, which involves alleged offences under Sections 30(a), 41(1) and 41(2) of the Bihar Prohibition and Excise Act for the seizure of 1,109.52 litres of illicit foreign liquor from a pick‑up vehicle. The petitioners contended that they were neither owners nor drivers of the vehicle, that their names were supplied by the apprehended driver, that no liquor was recovered from their possession, and that the seizure list lacked an independent witness and violated Section 105 of the BNSS. The State opposed bail, highlighting the petitioners’ prior criminal antecedents—three cases for Raju Yadav, four for Ayush Gupta and three for Sudhir Sahni. After hearing both sides, the Court was persuaded by the petitioners’ claim of lack of direct involvement and procedural lapses in the seizure. Accordingly, the Court ordered that the petitioners be enlarged on anticipatory bail, subject to surrender within four weeks, a bail bond of Rs 10,000 with two sureties, and compliance with Section 482(2) of the BNSS. The order was pronounced by Justice Ashok Kumar Pandey.
