Holding

The court granted bail to the petitioner, subject to a bond and sureties.

Summary

Vikram Kumar Ram, a surveyor, was arrested in connection with a vigilance case alleging he accepted a bribe of Rs. 20,000 under Section 7(a) of the Prevention of Corruption Act, 1988. The petitioner applied for bail, claiming innocence, lack of prior criminal record, and that the charge-sheet had already been filed. The State opposed the bail, arguing the seriousness of the alleged corruption offence. The court noted that the case relied solely on documentary evidence held by the prosecution and, considering the circumstances, decided to grant bail. The petitioner was released on bail upon furnishing a bond of Rs. 10,000 with two sureties of equal amount, with the court emphasizing that its observations were prima facie and not a determination on the merits of the case.

Issues considered
