Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Jyotish Mandal, was charged under several sections of the B.N.S. and the Arms Act for allegedly assaulting a woman with the butt of a pistol during a dispute. He applied for regular bail, asserting his innocence, a clean antecedent, and that the injury was minor with no fracture as per the medical report. The State opposed the bail. The court considered the monetary nature of the dispute, the simple injury, and the length of custody, and decided to grant bail on a bond of Rs.10,000 with two sureties. The order expressly states that the observations are prima facie and not to influence the trial. Consequently, the petitioner was released on bail pending trial.

Issues considered

  • Whether regular bail should be granted to the petitioner despite the serious charges under the B.N.S. and Arms Act.
  • Whether the nature of the alleged injury and the monetary dispute justify granting bail.
