Patna High Court

Kundan KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted as the FIR did not establish a cognizable offence against the petitioner under Section 30(a).

Summary

The petitioner, Kundan Kumar, feared arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act after police seized 100 litres of illicit liquor from a wheat field, but no liquor was found in his conscious possession. He applied for anticipatory bail, arguing that the seizure did not constitute an offence against him. The State opposed, citing the petitioner’s criminal antecedents. The Court, relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar (2019) which allows anticipatory bail despite the bar in Section 76(2) when the FIR does not disclose a cognizable offence, held that no offence was made out against the petitioner. Consequently, the Court granted anticipatory bail with a bond of Rs.10,000 and several conditions under Section 438(2) of the Cr.P.C.

Issues considered

  • Whether anticipatory bail can be granted under the Bihar Prohibition and Excise Act when the alleged seizure is not from the accused's conscious possession.
  • Whether the bar under Section 76(2) of the Bihar Prohibition and Excise Act precludes an anticipatory bail application in this circumstance.

                                2. The petitioner is apprehending arrest in connection

with Noorsarai P.S. Case No. 105 of 2026 instituted under

Section 30(a) of the Bihar Prohibition and Excise Act.

                                3. As per the prosecution story, the police, on secret

information, reached the wheat field where there is

recovery/seizure of 100 liters of country-made liquor and the

local people disclosed the name of the accused, including the

petitioner, which led to the FIR.

                                4. Learned counsel for the petitioner submits that the

recovery/seizure is 100 liters and not from the conscious

                   possession.

                                5. Further, learned counsel for the petitioner relied on

the case of Ram Vinay Yadav vs. State of Bihar reported in

2019(2) PLJR 1089 wherein it has been held that an application

for anticipatory bail in a case arising our of Bihar Excise and

Prohibition Act can be maintained, despite the bar under Section

76(2) of the Act, if on the basis of allegation made in the FIR,

no offence under the said provision is made out.

                       6. Learned APP, Mr. Narsingh Tanti opposes the

prayer submitting that he has criminal antecedent.

                       7. Taking into account the submissions of the parties

and the judgment in the case of Ram Vinay Yadav (supra), as

also that nothing has been recovered from the conscious

possession, in that background this Court is inclined to extend

him the privilege of anticipatory bail.

                       8. Let the petitioner be released on bail, in the event

of his arrest or surrender before the concerned court within a

period of four weeks from the receipt of this order, on furnishing

bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of

the like amount each in connection with Noorsarai P.S. Case
