BAIL GRANTED

Holding

The Court granted bail to the petitioner upon the condition of a Rs.10,000 bond and two sureties.

Summary

The petitioner, Saurav Kumar, was arrested in connection with a shooting incident on 8 March 2023 in which firearms were used to create havoc in a market. He is charged under Sections 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner claims he was falsely implicated due to village politics and has been in custody since 20 December 2025, with charges framed on 7 April 2026. He applied for bail, while the State opposed the relief. The Court, noting the length of custody and that charges have already been framed, ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties of the same amount.

Issues considered

  • Whether bail should be granted to the petitioner charged with attempt to murder, common intention, and unlawful possession of arms, considering the nature of the offence and the period of custody.
