Holding

The Court granted bail to the petitioner.

Summary

Shivam Chaudhary applied for bail in a case registered under Sections 61(2), 109 and 3(5) of the Bihar Narcotic Substances Act, 2023 and Section 27 of the Arms Act. The incident involved an informant being shot while seated with the petitioner; two unknown persons fired the shots. The petitioner was not named in the FIR; his name surfaced only through a confessional statement of a co‑accused during investigation. The petitioner’s counsel argued that he was falsely implicated and has no direct involvement, while the State opposed bail. Considering that the petitioner was not an original accused, the reliance on a co‑accused’s confession, and his period of custody, the Court granted bail on a bond of Rs. 10,000 with two sureties, noting that the observation is prima facie and does not affect the trial.

Issues considered

  • Whether bail should be granted to a person not originally named in the FIR but later implicated through a co‑accused’s confessional statement.
  • Whether the nature of the offences (narcotic and arms offences) warrants denial of bail.
  • Whether the period of custody and lack of direct evidence against the petitioner justify bail.

present case. The FIR is lodged against two unknown persons

and the petitioner is not named in the FIR. The name of the

petitioner sprung up in the present case as conspirator during the

course of investigation on the basis of confessional statement of

the co-accused Saurav Kumar Jha. Learned counsel lastly

as well as the fact that his name came on the confessional

statement of the co-accused during investigation and further

considering his period of custody, this Court is inclined to grant

          bail to the petitioner.

                          8. Accordingly, let the petitioner, above-named, be

released on bail on furnishing bail bonds of Rs. 10,000/-
