Nitish KumarversusThe State of Bihar

Holding

The Court granted regular bail to the petitioner, finding no specific allegation against him and deeming the bail bond sufficient.

Summary

The petitioner, Nitish Kumar, was implicated in a FIR alleging offences under sections 331(4), 191(3), 115(2), 126(2), 109 of the Indian Penal Code and section 27 of the Arms Act, arising from an incident where miscreants attacked an informant’s family and shot the informant’s son. The petitioner argues that the FIR contains only a general, omnibus allegation and that his name appears solely in the confessional statement of a co‑accused, with no specific charge against him. He has been in judicial custody since 25‑02‑2025 and seeks regular bail. The State opposes the bail on the ground of the serious nature of the offences. After hearing both sides, the Court found the lack of specific allegation against the petitioner sufficient to grant regular bail, directing him to furnish a bail bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail when his name appears only in a co‑accused’s confessional statement and no specific charge is framed against him.
  • Whether the seriousness of the offences under the IPC and Arms Act justifies denial of bail.
  • Whether an omnibus FIR affects the court’s discretion to grant bail.
