Patna High Court

Dharmveer Yadav @ Dharmveer KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petitioner is entitled to bail and is released on condition of a bond and sureties.

Summary

The petitioner, Dharmveer Yadav, was named in an FIR for multiple offences, including assault with a knife and alleged theft of Rs.20,000, arising from an incident where his sister was allegedly eve‑teased. He argued that the specific knife‑injury allegation pertained to other co‑accused and that the theft charge was imaginary, emphasizing his clean antecedents. The State opposed bail, citing the seriousness of the charges. The Court noted that the primary knife‑injury allegation was against the co‑accused and that the petitioner’s alleged involvement was limited to a theft claim, and therefore, prima facie, he could be released on bail. Accordingly, the Court ordered his release on bail with a bond of Rs.10,000 and two sureties, subject to conditions under Section 482(2) of the Criminal Procedure Code.

Issues considered

  • Whether the petitioner is entitled to bail despite being named in the FIR for multiple offences
  • Whether the allegations against the petitioner constitute a prima facie case warranting denial of bail
