Sani Raj SahversusThe State of Bihar

Decided

BAIL GRANTED

Holding

Anticipatory bail may be granted under the Bihar Prohibition and Excise Act even where section 76(2) bars bail, provided the allegations do not constitute an offence and the petitioner is not in conscious possession and has no criminal antecedent.

Summary

The petitioner, Sani Raj Sah, sought anticipatory bail after an FIR was lodged under section 30(a) of the Bihar Prohibition and Excise Act for the alleged seizure of 38.970 litres of English wine from his vehicle, which he claimed was not in his conscious possession and had been given to a third party for family treatment. The prosecution argued that the petitioner owned the car and was therefore liable. The petitioner relied on the Full Bench decision in Ram Vinay Yadav v. State of Bihar (2019 (2) PLJR 1089), which permits anticipatory bail in Excise cases despite the bar in section 76(2) if no offence is made out. The court, noting the lack of conscious possession, absence of criminal antecedent, and the cited precedent, granted anticipatory bail with specific conditions regarding sureties, appearance before police and court, and non‑interference with witnesses. The order directed the petitioner to furnish a bail bond of Rs 10,000 with two sureties and comply with the stipulated conditions.

Issues considered

  • Can anticipatory bail be granted in a case under the Bihar Prohibition and Excise Act despite the bar under section 76(2) of the Act?
  • Does the petitioner’s lack of conscious possession and clean criminal record justify the grant of anticipatory bail?
  • Do the allegations in the FIR constitute an offence under section 30(a) of the Bihar Prohibition and Excise Act?

                                       ORAL ORDER

2 21-05-2026 Heard the parties through virtual mode.

                                 2. The petitioner is apprehending his arrest in

connection with Durgawati P.S. Case No. 64 of 2026 for the

offence under sections 30(a) of the Bihar Prohibition and Excise

Act lodged on 27.02.2026 by the informant, Vijendra Ram.

                                 3. As per the prosecution story, the Police during

patrolling a car was found in a accident state and there is

recovery/seizure of 38.970 liter English Wine. This led to the

                   FIR.

                                 4. Learned counsel for the petitioner submits that

nothing has been recovered from his conscious possession and

being the vehicle owner, it was given to one Manu Kumar for

treatment of his family member and in this way he got

implicated. Further submissions is that he has no criminal

          antecedent.

                       5. Further, learned counsel for the petitioner relied on

the judgment of the Full Bench of Hon’ble Patna High Court in

the case of Ram Vinay Yadav vs. State of Bihar reported in

2019 (2) PLJR 1089 wherein it has been held that an

application for anticipatory bail in a case arising out of Bihar

Excise and Prohibition Act can be maintained, despite the bar

under Section 76(2) of the Act, if on the basis of allegation

made in the FIR, no offence under the said provision is made

          out.

                       6. Learned APP Mr. Jitendra Kumar Singh, opposes

the prayer submitting that he is owner of the said car.

                       7. Taking into account the submissions of the parties

and the judgment in the case of Ram Vinay Yadav (supra), as

also that nothing has been recovered from his conscious nor he

has criminal antecedent, in that background, this Court is

inclined to extend him the privilege of anticipatory bail with

          conditions.

                       8. Let the petitioner be released on bail in the event of

arrest or surrender within a period of four weeks from the

receipt of this order, on furnishing bail bond of Rs. 10,000/-
