The court granted regular bail to the petitioner.

Summary

The petitioner, Sahil Kumar, was arrested in connection with a case alleging the seizure of 112 litres of country-made liquor, alleged to be an offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. The petitioner claimed innocence, stating that no liquor was found in his possession and that the seizure was conducted without compliance with Section 105 of the B.N.S.S, relying only on a local chowkdiar's statement. He had been in judicial custody since 25 March 2026 and had no prior criminal record. The State opposed the bail application, while the petitioner’s counsel sought regular bail. After hearing both sides, the court found the circumstances warranted bail and ordered the petitioner’s release on a bail bond of Rs.10,000 with two sureties, subject to the satisfaction of the Exclusive Special Court of Excise, Patna.

Issues considered

  • Whether regular bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
  • Whether the seizure of the liquor complied with procedural requirements, specifically Section 105 of the B.N.S.S.
  • Whether the petitioner poses a risk of fleeing, tampering with evidence, or committing further offences.
