Patna High Court

Ranjit Rai @ Ranjit kumarversusThe State Of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was denied.

Summary

The petitioner, Ranjit Rai, sought anticipatory bail fearing arrest in a case (PS No.20 of 2026) filed under multiple sections of the Bihar Penal Code for alleged assault causing injuries to Rinku Kumari. The prosecution alleged that the petitioner assaulted the victim, resulting in a nasal fracture, as recorded in the FIR. The petitioner contended that the FIR was exaggerated and stemmed from a land dispute between the parties. The State opposed the bail, emphasizing the medical evidence of injury. After considering the submissions, the Court found the allegations serious enough to deny any relief, rejecting the anticipatory bail application.

                                2. The petitioner is apprehending arrest in connection

with Tariyani Chhapra P.S. Case No. 20 of 2026 instituted for

                   offences under Sections 126(2), 115(2), 118(1), 117(2), 109(1),

                   303(2), 352, 351(2) & 3(5) of BNS. lodged on 20.03.2026 by

                   the informant, Nagendra Kumar.

                                3. As per the prosecution story, the informant alleged

that due to minor dispute, the accused persons resorted to

assault and so far as this petitioner is concerned, the allegation is

that he assaulted Rinku Kumari causing injury below the eyes

and on the nose. The assault theory has also been assigned to

other accused persons. This led to the FIR.

                                4. Learned counsel for the petitioner submits that

there is land dispute between the parties and an exaggerated FIR

                     has been lodged.

                                  5. Learned APP opposes the prayer submitting that a

bare perusal of the learned Sessions Judge order would show

that fracture of nasal has been recorded.

                                  6. Considering the submissions of the parties as also

the kind of allegation that has come against the petitioner, no

                     relief can be granted.

                                  7. The anticipatory bail stands rejected.
