Decided

BAIL GRANTED

Holding

The court held that anticipatory bail is warranted in the present case, subject to the conditions of Section 482(2) of the BNS.

Summary

The petitioner, Mithlesh Kumar, sought anticipatory bail fearing arrest in a case (Sheikhpura PS Case No. 188 of 2025) alleging impersonation during a Home Guard Physical Efficiency Test, charged under Sections 319(2), 318(4) and 3(5) of the Bharitya Nagrik Suraksha Sanhita (BNS). He argued that he was not named in the FIR, that the alleged offender had already obtained anticipatory bail, and that he is a student with no prior criminal record. The State opposed the bail, contending the seriousness of the offences. The Court examined the facts, noted the petitioner’s lack of criminal antecedents, and applied the provisions of Section 482(2) of the BNS. It granted anticipatory bail, subject to a bail bond of Rs 10,000 and two sureties, and imposed conditions as per the statute. The application was allowed.

Issues considered

  • Whether anticipatory bail can be granted in a case under Sections 319(2), 318(4) and 3(5) of the BNS
  • Whether the petitioner’s non‑inclusion in the FIR affects his eligibility for anticipatory bail
  • Whether the conditions prescribed under Section 482(2) of the BNS are applicable
