Patna High Court

Ranjan Kumar @ Sultha @ Ranjan RajakversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner on condition of a Rs.10,000 bond with two sureties.

Summary

The petitioner, Ranjan Kumar, was arrested in connection with a case registered under several sections of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act. The FIR alleged that the petitioner was present when a group of persons fired shots in the air during an altercation, but no weapon or incriminating article was recovered from him and no person sustained injury. The petitioner contended that the allegations were vague, he had been falsely implicated, and that a co‑accused, Ranveer Kumar, had already been released on bail. The State opposed the bail application, citing the seriousness of the charges. The Court, noting the absence of any injury, the prior bail to a similarly situated co‑accused, and the petitioner’s prolonged pre‑trial detention since 19‑August‑2025, ordered his release on bail. Bail was granted upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail despite charges under the Bharatiya Nyaya Sanhita and the Arms Act
  • Whether the lack of any injury or recovered incriminating article justifies bail
  • Whether the grant of bail to a co‑accused influences the bail decision for the petitioner
