The Court granted anticipatory bail to the petitioner, subject to strict conditions, despite the statutory provision barring pre‑arrest bail.
Summary
The petitioner, Pintu Kumar, was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act for the alleged recovery of 210 litres of spirit. He contended that he had a clean antecedent and was falsely implicated, relying solely on a co‑accused's statement that a motorcycle was sold to him, with no material recovered from his possession. The State opposed anticipatory bail, invoking Section 76(2) of the same Act which bars pre‑arrest bail. The Court, referring to the Full Bench decision in Ram Vinay Yadav v. State of Bihar, considered the lack of direct evidence against the petitioner and granted anticipatory bail subject to a bond of Rs.10,000 and several conditions under Section 438(2) of the CrPC. The order required the petitioner to cooperate with the trial, appear in court as directed, and prohibited tampering with evidence or witnesses, with provisions for bail cancellation upon breach.
Issues considered
- Whether anticipatory bail can be granted under Section 438 CrPC when the offence is punishable under Section 30(a) of the Bihar Prohibition and Excise Act and Section 76(2) of that Act disallows pre‑arrest bail.
- Whether the mere disclosure by a co‑accused, without any material recovered from the petitioner, suffices to deny anticipatory bail.
