Patna High Court

Bul Bul Devi @ Bul Bul KumariversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The application for regular bail is allowed.

Summary

Bul Bul Devi, the petitioner, was arrested in connection with a murder case (Sections 302 and 34 IPC) alleging she and co‑accused killed the son of an informant, Dharamveer Kumar. The petitioner claimed innocence, stating that the deceased had actually committed suicide and the body was discovered after a broken door. She has been in custody since 13‑02‑2026 and has no prior criminal record. The State opposed her regular bail application. The Court, after considering the facts and the petitioner's submission, allowed the bail application, directing release on a bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the CrPC.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being charged under Sections 302 and 34 of the IPC
  • Whether the claim of suicide by the deceased negates the prosecution's case
  • Whether bail can be granted subject to conditions under Section 482(2) of the CrPC
