The court granted anticipatory bail to the petitioner subject to conditions under Section 438(2) of the CrPC.
Summary
Santosh Rai applied for anticipatory bail after being implicated in a case under Sections 30(a) and 41 of the Bihar Prohibition and Excise Act for alleged involvement in illegal foreign liquor trade. The prosecution’s case relied solely on the statement of a co‑accused, Vikash (Vinit Kumar Rai), and no liquor or other incriminating material was found in Rai’s possession. Rai argued that the accusation was false and that the FIR and seizure list did not link him directly to the contraband. The State opposed bail, invoking Section 76(2) of the Bihar Prohibition and Excise Act and citing Rai’s three pending cases, though none were excise‑related. The High Court, referring to the Full Bench decision in Ram Vinay Yadav v. State of Bihar, held that anticipatory bail could be granted where the evidence against the petitioner is tenuous, and ordered bail subject to conditions under Section 438(2) of the CrPC.
Issues considered
- Whether anticipatory bail can be granted under Section 438 CrPC when the only evidence is the co‑accused’s testimony and no material is seized from the petitioner.
- Whether Section 76(2) of the Bihar Prohibition and Excise Act bars the grant of anticipatory bail.
- Whether the petitioner’s prior criminal antecedents, unrelated to excise offences, affect the bail decision.
