The court granted anticipatory bail to the petitioner, subject to conditions, despite the statutory bar under Section 76(2) of the Bihar Prohibition and Excise Act.
Summary
Mithilesh Bind was implicated in a case under Section 30(a) of the Bihar Prohibition and Excise Act for the alleged possession of 90 litres of illicit country-made liquor seized from a scooty and motorcycle. He contended that the only basis for his accusation was the statement of a co‑accused, Rajkumar Bind, and that no material was recovered from his conscious possession, nor were any independent witnesses recorded, violating Sections 103 and 105 of the BNSS. The State opposed anticipatory bail, invoking Section 76(2) of the Prohibition Act and citing the petitioner’s prior criminal antecedents. Relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar, the court held that anticipatory bail could be granted despite the statutory bar, given the lack of direct evidence. Accordingly, the court ordered anticipatory bail under Section 438(2) of the CrPC, subject to a Rs 10,000 bail bond, sureties, and conditions regarding cooperation, non‑tampering with evidence, and verification of antecedents.
Issues considered
- Whether anticipatory bail can be granted under Section 438 CrPC when the accusation rests solely on a co‑accused’s statement and no material is recovered from the petitioner.
- Whether Section 76(2) of the Bihar Prohibition and Excise Act bars the grant of anticipatory bail in such circumstances.
- Whether non‑compliance with Sections 103 and 105 of the BNSS affects the petitioner’s right to anticipatory bail.

He further submits that it appears from the F.I.R as well as
seizure list that altogether 90 litres of country made liquor was
recovered from the scooty and motorcycle in question and co-
accused person, Rajkumar Bind has disclosed that the petitioner
was involved in the present crime in question. Apart from that
nothing has come during investigation which suggest the
involvement of the petitioner in the present occurrence. It
appears from the seizure list that seizure list witnesses are police
personnel, so there is non-compliance of Section 103/105 of the
BNSS. No case, whatsoever, would be made out against the
petitioner under the Bihar Prohibition and Excise Act.
5. The learned Additional Public Prosecutor has
vehemently opposed the prayer for anticipatory bail of the
petitioner referring the provision contained in Section 76(2) of
the Bihar Prohibition and Excise Act and submitted that the
pre-arrest bail would not be maintainable. He further submits
that the petitioner carries two criminal antecedents other than
the present one but fairly submits on the basis of paragraph-3 of
the bail application that the petitioner is on bail in the said
matters.
6. This court is aware of the decision of the Full
Bench in the case of Ram Vinay Yadav vs. State of Bihar
