Holding

Bail is granted to the petitioner subject to a bond of Rs.30,000 and conditions under the Bihar Narcotic Substances (Suppression) Act, 2023.

Summary

Pato Devi, a 48‑year‑old woman, was apprehended for alleged possession of 18 litres of illicit liquor recovered from her house in connection with a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. The petitioner claimed innocence, stating that nothing was found in her conscious possession and that she had no criminal antecedent. The State opposed her bail application. The High Court, after considering the facts, granted bail on the condition of a Rs.30,000 bond under Section 2(1)(d) of the Bihar Narcotic Substances (Suppression) Act, 2023, and subject to the conditions of Section 482(2) of the same Act. The trial court was directed to verify any criminal antecedent and cancel the bail if concealment is discovered. The order was pronounced by Justice Dr. Anshuman.

Issues considered

  • Whether bail should be granted to the petitioner in a case of alleged illicit liquor possession under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022
