Patna High Court

Krish Sharma @ Krishna Sharma @ Krish Kumar SharmaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner, directing him to furnish a bail bond of Rs. 10,000 with two sureties.

Summary

Krish Sharma petitioned for bail in a criminal case registered under Sections 80, 238 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section ¾ of the Dowry Prohibition Act, alleging that he conspired with others to kill the daughter of an informant over a dowry demand. The prosecution contended that Sharma was part of a conspiracy that resulted in the death, while the petitioner argued that he is the cousin father‑in‑law of the deceased, that the deceased had actually committed suicide, and that the husband of the deceased is already in custody. He also highlighted his clean criminal record and that he had been detained since 3 January 2026. The State opposed the bail. Considering the familial relationship, the custody of the husband, the lack of prior criminal history, and the circumstances presented, the Court ordered that Sharma be released on bail upon furnishing a bond of Rs. 10,000 with two sureties of equal amount.

Issues considered
