Patna High Court

Surendra BhoktaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner on the condition of furnishing a bail bond and sureties.

Summary

The petitioner, Surendra Bhokta, was arrested in February 2025 for alleged cultivation of opium on 20 katha of forest land, charged under Sections 8, 17 and 18 of the NDPS Act. He claimed innocence, stating that only five kilograms of opium plants were recovered and that co‑accused had already been granted bail. Having been in custody for about eleven months, he sought regular bail, arguing his clean antecedents. The State opposed the bail application. The Court considered the nature of the offence, the length of incarceration, and the petitioner’s willingness to cooperate, and ordered that he be released on regular bail upon furnishing a bond of Rs 10,000 with two sureties of the same amount, subject to appearing before the trial court on all dates. The order directs the lower court to release the petitioner on bail under the stipulated conditions.

Issues considered

  • Whether the petitioner is entitled to regular bail under the NDPS Act despite the seriousness of the offences and the period of pre‑trial detention.
