Patna High Court

Rajo SharmaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court ordered the release of the petitioners on bail, subject to a bond and conditions prescribed under the Bharatiya Nyaya Sanhita, 2023.

Summary

The petitioners, Rajo Sharma and Kaushal Kumar, sought bail fearing arrest in connection with FIR No. 24 of 2026 alleging offences under Sections 126(2), 115(2), 109(1), 352, 351(2), 351(3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. The prosecution alleged that the petitioners assaulted an informant and his son with lathis, causing grievous injuries. The petitioners contended they were innocent, asserting that the incident stemmed from an election dispute and that both sides had filed cases and counter‑cases, with the injury report indicating blunt‑force trauma rather than a knife attack. The State opposed bail, but the court noted the existence of reciprocal cases and applied the bail provisions of the B.N.S.S. The court granted bail to both petitioners on a bond of Rs.30,000 each, subject to conditions under Section 2(1)(d) and Section 482(2) of the Bharatiya Nyaya Sanhita, 2023.

Issues considered

  • Whether bail should be granted to the petitioners despite the seriousness of the alleged offences under the Bharatiya Nyaya Sanhita, 2023.
  • Whether the existence of a counter‑case and the nature of the injuries affect the bail decision.
  • Application of Section 2(1)(d) and Section 482(2) of the Bharatiya Nyaya Sanhita, 2023 in granting bail.

connection with Pasraha P.S. Case No. 24 of 2026 lodged on

attack by knife. Counsel further submits that the petitioner no.1

has one criminal antecedent in which he is on bail and the

petitioner no.2 has two criminal antecedents and in both the

          cases, he is on bail.

                       6. Learned APP for the State opposes the prayer for

bail of the petitioners but fairly submits that for the same date
