Holding
Bail was granted to both petitioners subject to a bond and conditions under Section 438(2) CrPC and Section 482(2) BNSS.
Summary
The petitioners, Madan Mohan Kumar and Mirtunjay Kumar, were named in an FIR for alleged kidnapping of a 16‑year‑old girl under IPC sections 363, 365 and 34. The girl later gave a statement under Section 183 of the Bihar Negotiable Security Act (BNSS) that she left home of her own free will and made no incriminating remarks against the petitioners. The petitioners claimed they had married the girl, had a child, and filed a joint compromise petition before the trial court. The State opposed bail, but the court noted the victim’s voluntary statement, the petitioners’ clean antecedents, and the existence of a compromise. Consequently, the court ordered bail for both petitioners with a bond of Rs 10,000 and two sureties each, subject to conditions under Section 438(2) of the CrPC and Section 482(2) of the BNSS.
Issues considered
- Whether bail should be granted to the accused despite the FIR under Sections 363, 365 and 34 IPC
- Whether the victim’s voluntary statement and the filed compromise affect the bail decision
- Whether the conditions under Section 438(2) CrPC and Section 482(2) BNSS are satisfied
