Patna High Court

Babu @ Mukesh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a bond and specified conditions.

Summary

The petitioner, Babu @ Mukesh Kumar, was arrested on 24-04-2026 in connection with a case involving the seizure of 68.5 litres of country-made liquor, alleged to be an offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2018. He contended that the liquor was recovered from the premises of co‑accused and that no material linked him directly to the crime, asserting his innocence. The prosecution highlighted the petitioner’s fourteen prior criminal records, though noting he was on bail in nine other cases and the remaining were pending. The court examined the lack of direct evidence against the petitioner and the nature of his prior offences, and decided to grant bail. Bail was conditioned on a Rs.10,000 bond with two sureties, cooperation with the trial, presence in court, and no tampering with evidence or concealment of antecedents.

Issues considered

  • Whether bail should be granted to the petitioner despite prior criminal antecedents and the nature of the offence under the Bihar Prohibition and Excise Act, 2018.
  • Whether the absence of material recovered from the petitioner’s possession justifies bail.
