Patna High Court

Gandhi Ray @ Gondhi RayversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The High Court granted anticipatory bail to the petitioner subject to specified conditions.

Summary

The petitioner, Gandhi Ray, sought anticipatory bail fearing arrest in a dowry‑related complaint (Case No. 1221 of 2023) alleging offences under IPC Sections 406, 352, 498A and 120B. The prosecution alleged that he assaulted and tortured the victim to extract dowry, while the petitioner claimed innocence and false implication. The State opposed the bail application. Relying on the Supreme Court’s guidelines in Arnesh Kumar v. State of Bihar (2014) 8 SCC 273, the High Court allowed the anticipatory bail, directing a bail bond of Rs.10,000 with two sureties and imposing conditions under Section 438(2) CrPC and Section 482 of the BNSS. Additionally, the Court ordered the petitioner to pay a monthly maintenance of Rs.10,000 to the informant, subject to any future maintenance proceedings.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 of the CrPC in view of the facts and the precedent set by Arnesh Kumar v. State of Bihar.
  • Whether the imposition of bail conditions, including a maintenance order, is permissible.
